Hi,
I had applied for my Essential Skill work visa in Feb 2019, we were been interviewed thrice, we waited for their decision they did nothing my interim visa also expired. Since it was not my fault they said they were still doing verification on Employers check they gave me two months visitor visa as an extension. There were 8 staff who applied for work visa , out of them 5 got approval and 3 remaining including me they send PPI with employer compliance issue. The point is just before a week they approved few visa and for us they send a PPI. What to do in this case, and can we expect for visa now ?
Thanks
It is possible that by now, you have resolved your matter but I will respond to this question so that others in a similar situation may benefit.
If INZ has raised concerns about your employer not being compliant, it is important to establish if they actually have been compliant or not. If you think that your employer has been compliant but INZ is incorrectly raising the concerns, then you can submit additional information and submissions from your employer to prove this to INZ. If you think that your employer has not been compliant and that INZ is being unfair by granting a work visa to some other employees while not granting this to you, then I recommend that you/your immigration adviser/lawyer raises this concern on phone with the immigration offer or their manager and ask them to explain how they are applying the principles of fairness and natural justice. Despite this, it is possible that INZ may decline to make any comments and shrug off stating that each case is decided on its own merits but it is worthwhile asking INZ for an explanation.
Without knowing the extent of compliance issues, it is not possible to make any comments but many times, it is also important to establish the timeline when the employer was not compliant and since then, what steps they have followed to ensure that they remain compliant. At the same time, if you end up having to go back to your home country, you can always apply for a new visa again. Please feel free to contact us if your matter is not yet resolved.
Kind regards,
Malkiat Singh
